欢迎您使用 造视（英文名称 Zoovis，以下简称「本服务」「本产品」或「造视」）。

请您在开始使用前认真阅读本协议，特别是免除或限制责任、争议解决、法律适用等条款。若您不同意本协议任何内容，请停止使用本服务。您通过网络页面点击同意、实际下载安装或使用本服务，即视为您已阅读并同意受本协议约束。

一、定义与协议范围

  1. 运营方：指提供本服务的法律主体Nanjing Chacha Technology Co., Ltd（We / Operating Entity: Nanjing Chacha Technology Co., Ltd）及其关联方（以下简称「我们」）。
  2. 用户：指访问、下载、注册或使用本服务的自然人（以下简称「您」）。
  3. 本协议：指《造视（Zoovis）用户服务协议》（英文名称参照：Zoovis User Terms of Service）及其不时更新的版本；我们可能通过应用内公告、网站公示等方式发布补充规则，补充规则为本协议组成部分；若与正文冲突，以更新后对您权益影响更重的一方为准时，我们将以合理方式提示您。

二、服务内容

  1. 造视（Zoovis）是一款以 AI 图像生成为核心的应用程序，提供包括但不限于：模板与灵感引导、文生图 / 图生图等生成能力（以实际上线功能为准）、作品历史与管理、将生成结果保存至系统相册等功能。
  2. 我们可能基于产品迭代、模型提供方政策、法律法规要求等原因，对功能、界面、模型种类、参数选项等进行调整、中止或下线，并将尽力通过合理方式告知您。
  3. AI 生成内容具有不确定性与随机性，输出结果仅供创意参考，不构成任何专业意见（包括但不限于医疗、法律、金融、工程设计等领域）。

三、账号与登录

  1. 您可通过 通过 Apple 登录（Sign in with Apple） 等方式（以应用内实际提供的为准）创建或关联账号。
  2. 您应使用本人合法持有的 Apple ID 完成授权，并保证授权信息真实、准确。因账号保管不善或第三方冒用导致的损失，除法律法规另有规定或我们存在过错外，由您自行承担。
  3. 我们有权基于安全、合规或风险控制需要对异常登录、批量注册、滥用行为采取限制措施，包括但不限于暂停功能、冻结账号或终止服务。
  4. 若法律法规或 Apple 政策要求提供 账号删除入口，您可按应用内指引申请注销。注销后，您在法律法规要求的范围内可能无法恢复数据，具体以产品说明与后台实现为准。

四、积分、充值、兑换码与订阅

  1. 本服务可能采用 积分作为数字化消耗单位，用于抵扣图像生成等服务用量；积分规则、计价方式、展示入口以应用内及我们的公示为准。
  2. 您可通过 应用内购买（IAP）、兑换码、订阅权益等方式获得积分或额度（以实际上线商品为准）。苹果 App Store 渠道的交易关系受 Apple 条款约束；关于账单、退款、订阅续费与取消等，您可同时参阅 Apple 的相关说明。
  3. 积分及虚拟权益的性质为 数字化商品或服务，除法律法规强制性规定、Apple 政策或我们另行公示外，可能不适用无理由退货；已兑换或已消耗的积分通常无法退还。
  4. 若您通过订阅获得周期性额度，订阅生效、续订、到期与宽限期等以 App Store 订阅机制及我们的规则为准；我们可能依据 Apple 服务器通知或合法对账流程调整您的账户权益。
  5. 禁止以作弊、自动化脚本、逆向、利用漏洞等方式获取或使用积分；我们有权追回不当得利并追究法律责任。

五、用户行为规范

  1. 您承诺遵守法律法规、公序良俗及本协议，不得利用本服务从事下列行为（包括但不限于）：
    • 侵害他人名誉权、肖像权、隐私权、知识产权或其他合法权益；
    • 生成、传播淫秽、赌博、暴力、恐怖、仇恨、歧视性或其他违法违规内容；
    • 生成虚假新闻、误导性信息用于欺诈或非法目的；
    • 绕过或破坏安全措施、干扰服务正常运行、抓取非公开接口或大量恶意请求；
    • 其他我们有合理理由认为不适宜的行为。
  2. 您输入的 提示词、参考图及生成结果由您自行负责。您应确保对所上传内容拥有合法权利或已获得授权，且不会侵犯第三方权益。
  3. 我们有权依据法律法规、监管要求、Apple 政策或模型提供方规则，对输入与输出采取过滤、拦截、拒绝服务或向有权机关报告等措施。

六、知识产权与内容归属

  1. 本服务涉及的软件、界面设计、商标、模板编排（不含用户独创部分）等知识产权归我们或权利人所有。
  2. 关于 AI 生成图像的权利归属与商用许可，法律关系各国/各地区可能存在差异且仍在发展中。在法律法规允许的范围内，您可以依据应用内公示、付费档位说明或我们另行授予的许可范围使用生成结果；若您需在特定司法辖区进行大规模商用，建议自行咨询专业律师并完成必要的权利审查。
  3. 若您认为本服务展示的内容侵犯您的合法权益，可通过 service@miooc.cn（邮件主题请注明「侵权投诉」）向我们提交合格通知，我们将在核实后依法处理。

七、第三方服务

  1. 本服务可能依赖 云服务、模型网关、支付与登录（如 Apple） 等第三方。第三方服务受其各自用户协议与隐私政策约束；因第三方原因导致的服务中断或损失，我们将尽力协助排查，但不对第三方行为承担超出合理范围的责任。
  2. 为完成图像生成，您的指令与必要参数需由我们的后端转发至 模型提供方 / 网关处理，具体数据处理规则见《造视（Zoovis）隐私政策》（英文名称：Zoovis Privacy Policy）。

八、免责声明与责任限制

  1. 本服务按 「现状」和「可获得性」提供。在法律允许的最大范围内，我们对下列情形不承担责任：
    • 因不可抗力、网络故障、设备兼容性、第三方服务中断等导致的服务暂停或数据丢失；
    • AI 输出与您的预期不符、存在瑕疵或引发争议；
    • 您因违反本协议或法律法规而被采取限制措施或处罚。
  2. 除非法律法规另有强制性规定，我们对您承担的全部责任上限以争议发生前十二个月内您为涉争功能实际向我们支付的金额为限（若仅为免费使用，则以零或法律法规允许的最低标准为限）。
  3. 部分司法辖区不允许排除特定担保或限制责任，则在该辖区法律允许范围内以最大限度合规方式解释本条。

九、协议变更与终止

  1. 我们可能修订本协议，并通过应用内提示、网站公告等合理方式通知您。若您不同意修订内容，应停止使用；您在生效日期后继续使用，视为接受修订。
  2. 您可随时停止使用并卸载应用；我们也可在符合法律法规的前提下终止或暂停服务，并将尽力避免对您已付费权益的不合理损害。

十、适用法律与争议解决

  1. 本协议的订立、效力、解释与争议解决适用 中华人民共和国大陆地区法律（若您主要位于其他地区，请由法务改为适用法与管辖条款）。
  2. 因本协议引起的争议，双方应先友好协商；协商不成的，提交 Nanjing Chacha Technology Co., Ltd 住所地有管辖权的人民法院诉讼解决（或改为仲裁条款，须法务审定）。

Welcome to Zoovis (English name Zoovis, collectively the “Product” or “this service”). Using the Product after clicking agree—or by downloading, installing, or signing in—means you accept these Terms, including disclaimers of liability and the governing law and dispute provisions.

If you do not agree, do not use the Product.

1. Definitions

  1. We / Operating Entity: Nanjing Chacha Technology Co., Ltd + affiliates.
  2. User: Individuals downloading/accessing/using Zoovis.
  3. Terms: Zoovis User Terms—including appendices—we publish materially conflicting supplements while highlighting impacts when required.

2. Service

  1. Zoovis focuses on AI media generation—templates, text/image hybrids, timelines, exporting to Photos—all subject roadmap flux.
  2. Features/UI/models parameters shift with compliance/model providers—notifications attempted reasonably.
  3. AI stochasticity ⇒ no professional/medical/legal/fiscal/engineering counselling guarantee.

3. Accounts

  1. Use Sign‑in with Apple/other surfaces Zoovis provides.
  2. Guard Apple ID personally—tampering losses absent Our fault ⇒ Yours legally.
  3. Abuse-triggered throttles permissible—freezes/closures may apply.
  4. Deletion flows may be offered where required—after deletion some data cannot be recovered under applicable law.

4. Credits, IAP codes & subscriptions

  1. Credits denote spendable metering—pricing surfaces Zoovis/Our bulletins dictate.
  2. Acquire quotas via Zoovis IAP/redemption giveaways/subscription entitlements as inventory exists—transactions within Apple realms honour Apple Agreements—study Apple refund/renewal literature likewise.
  3. Digital goods ordinarily escape no-fault reversing—consumption typically irreversible legally.
  4. Subscriptions obey App Store pulses + Zoovis overlays—balances align Apple notifications/accounting fairness.
  5. Cheating/forbidden scraping triggers reclaim + judiciary avenues.

5. Conduct

  1. Forbidden illustrative behaviour:
    • harming reputations/portraits/privacy/IP;
    • illicit/generated extreme content pipelines;
    • deepfake fraud infrastructures;
    • security defeating / infrastructure sabotage;
    • other conduct we reasonably deem inappropriate.
  2. Inputs/outputs accountability stays Yours—lawful licences mandatory.
  3. Filters/takedowns/authority cooperation possible per statutes/Apple/model vendor rules.

6. Intellectual property

  1. Zoovis stack remains Ours/rightsholders—excluding your original contributions.
  2. AI visual IP licensing internationally fluid—commercial scale demands counsel aligning with storefront tiers.
  3. service@miooc.cn handles infringement submissions labelled accordingly.

7. Third parties

  1. Upstream clouds/gateways/payments disclaim endless liability—we facilitate triage realistically.
  2. Image synthesis routes abide Zoovis Privacy Policy.

8. Disclaimer + liability ceilings

  1. As-is/as-available—disclaim disruptions from acts of God/networks/handsets/vendors—or AI divergence—or enforcement triggered by misconduct.
  2. Unless mandatory statutes elevate—aggregate Zoovis exposure ≤ fees remitted preceding twelve months attributable controversy—or 0 gratis paths.
  3. Irreconcilable jurisdictions ⇒ interpret tolerant maxima aligning local consumer codes.

9. Agreement evolution + exit

  1. Revisions surfaced—post-effective habitual usage embodies acceptance—or cease instead.
  2. You may stop using Zoovis at any time; we may suspend or terminate the service as permitted by law while seeking to avoid unreasonable harm to prepaid rights.

10. Governing law + disputes

  1. Chinese mainland statutes govern—respect irreducible consumer doctrines—adapt if multinational audiences mature per counsel audits.
  2. Negotiate politely first—persisting conflicts funnel courts exercising jurisdiction over Nanjing Chacha headquarters locale—or arbitration swaps when counsel adopts.
